Bei Nichtzustimmung, muß die Software von all Ihren Speichermedien gelöscht werden. 1. Alle Rechte bezüglich BASIC BACKUP liegen bei der Firma TOBIAS MEUSCHKE IT. 2. Der Erwerb von BASIC BACKUP ist nur innerhalb der Bundesrepublik Deutschland gestattet. Alle Downloads und Bestellungen aus dem Internet sind als lokale Transaktionen innerhalb der Bundesrepublik Deutschland (gemäß deutschen Rechts) zu betrachten. Der Erwerb der Software ist auch für Personen und Organisationen mit (Wohn-) Sitz außerhalb der Bundesrepublik Deutschland, gemäß den genannten Bedingungen, möglich. 3. Die Nutzung von Basic Backup unterliegt deutschem Recht. Für Nutzungen außerhalb der Bundesrepublik Deutschland wird anerkannt, daß dies ausschließlich nach deutschem Recht geschieht. 4. Basic Backup kann in 2 Versionen vorliegen: PERSONAL und FULL. 4.1. Die PERSONAL Version ist ausschließlich zum persönlichen Gebrauch vorgesehen. Eine Nutzung zu gewerblichen, kommerziellen oder sonstigen Zwecken ist nicht gestattet. Die PERSONAL Version unterliegt einigen Einschränkungen: - lediglich eine Projektdatei (statischer Name und Speicherort) kann genutzt werden - lediglich 25 Sicherungselemente (Dateien oder Verzeichnisse) stehen zur Verfügung - lediglich 8 Verzeichnisse könne spezielle Eigenschaften (alle Dateien sichern, Unterverzeichnisse einbeziehen) aufweisen Je Person ist lediglich die Nutzung einer Kopie (Installation / Kopie auf einem Datenträger - z.B. Computer, Wechselfestplatte) der PERSONAL Version von BASIC BACKUP gestattet. Die PERSONAL Version ist kostenlos und darf in unverändertem Zustand weitergegeben werden. Diese weitergabe darf jedoch nur kostenfrei erfolgen. 4.2 Die FULL Version ist die kostenpflichtige Vollversion (Keine Einschränkungen in der Funktion) von BASIC BACKUP und kann für einen Preis von 19,99 Euro je Lizenz bei der Firma TOBIAS MEUSCHKE IT erworben werden. Eine Einzellizenz berechtigt zur Nutzung einer Kopie (Installation / Kopie auf einem Datenträger - z.B. Computer, Wechselfestplatte) der FULL Version von BASIC BACKUP in Verbindung mit der erworbenen Lizenzdatei. Für Volumenlizenzen können individuelle Angebote erstellt werden. 5. Eine Manipulation oder Veränderung der Software ist nicht gestattet. 6. Eine Weitergabe, Manipulation oder unrechtmäßige Replikation oder Herstellung von Lizenzschlüsseln bzw. Lizenzdateien ist verboten. 7. TOBIAS MEUSCHKE IT kann keinerlei Haftung für Datenverluste, entgangene Gewinne oder sonstige Schäden, die durch die Nutzung von BASIC BACKUP entstehen, übernehmen. Eine Ausnahme dieser Regelung besteht nur bei nachweisbar grober Fahrlässigkeit seitens TOBIAS MEUSCHKE IT. 8. Jeder Verstoß gegen diese Lizenzvereinbarungen führt zum sofortigen Erlöschen der Nutzungsrechte und dem Entzug der Lizenz. TOBIAS MEUSCHKE IT behält sich weiterhin in diesem Fall eine straf- und/oder zivilrechtliche Verfolgung vor. 9. Alle Rechte, die hier nicht ausdrücklich freigegeben werden, verbleiben beim TOBIAS MEUSCHKE IT. 10. Sollte eine oder mehrere Bestimmungen der Lizenzvereinbarung unwirksam sein, so sind die übrigen Bestimmungen davon nicht berührt. 11. In the case of refusal, the software must be deleted from all your storage media. 1. All rights concerning BASIC BACKUP are property of the company TOBIAS MEUSCHKE IT. 2. The acquisition of BASIC BACKUP is permitted only within the Federal Republic of Germany. All Downloads and orders from the InterNet are to be regarded as local transactions within the Federal Republic of Germany (in accordance with German law). The acquisition of the software is also possible for persons and organizations with place of residence or office outside of the Federal Republic of Germany, in accordance with the conditions mentioned. 3. The use of basic Backup is subject to German law. For use outside of the Federal Republic of Germany it is recognized that this happens exclusively by German law. 4. Basic Backup can be present in 2 versions: PERSONAL and FULL. 4.1. The PERSONNEL version is exclusively intended for personal use. A use for commercial or other purposes is not permitted. The PERSONNEL version is subject to some restrictions: - only one project file (static name) can be used - only 25 backup elements (files or directories) are available - only 8 directories can have special characteristics (backup all files in directory, include subdirectories) For each person only the use of one copy (installation/copy on a storage device - f.e. computer hard disk, removable harddisk) of the PERSONNEL version of BASIC BACKUP is permitted. The PERSONNEL version is free of charge and may be passed on in unchanged condition. This passing on may take place however only free of charge. 4.2 the FULL version is the unrestricted full version of BASIC BACKUP and can be acquired for a price of 19,99 Euro for a single license from the company TOBIAS MEUSCHKE IT. A single license entitles you to use of one copy (installation/copy on a storage device - f.e. computer hard disk, removable harddisk) of the FULL version of BASIC BACKUP. For volume licenses individual offers can be provided. 5. A manipulation or a change of the software is not permitted. 6. A passing on, manipulation, replication or creation of license keys and/or license files is forbidden. 7. TOBIAS MEUSCHKE IT can not be made liable for data loss, lost profits or other damage, which may result from the use of BASIC BACKUP. An exception of this regulation exists only with demonstrably rough negligence on the part of TOBIAS MEUSCHKE IT. 8. Each offence against these license agreements leads to immediate expiring of the rights to use and the withdrawal of the license. In this case TOBIAS MEUSCHKE IT reserves itself the right of further criminal and/or civil pursuit. 9. All rights, which are not expressly released here, remain with TOBIAS MEUSCHKE IT. 10. Should one or more regulations of the license agreement be ineffective, then the remaining regulations of it are not affected. 11. In all other respects the AGB (terms of service) of the company TOBIAS MEUSCHKE IT apply.
